Inputs of the CSOs to the amendments to the law "On Social partnership"

At the plenary meeting of the Legislative Chamber of the Oliy Majlis on May 6, 2020, the draft laws on the development of the country's socio-economic life were considered. In line with discussion of other law the special attention was emphasized on the amendments and additions to the Law of the Republic of Uzbekistan “On Social Partnership”. The Parliamentarians have highlighted that the concept of the bill has a number of shortcomings.  The document caused a serious discussion of the members of the parliament. Thus, members of the Social democratic party of Uzbekistan and Uzbekistan's Liberal democratic party noted that the adoption of the bill will expand the institution of social partnership, ensure the participation of business entities in the implementation of social partnership, and will solve a number of other issues. The Deputy Ministers of Justice and Finance participated in the discussions remotely through video-conferencing, as well as other experts expressed their opinion on the adoption of the bill in the first reading, and in preparing it for the second reading, consider proposals for finalizing and improving the document. After a long debate, the draft law on its first reading was put to a vote; according to the results of voting, 3 votes were lacking for the conceptual adoption of the document. For the purposes of the draft law “On Amendments and Additions to the Law of the Republic of Uzbekistan “On Social Partnership”.

In this regard, considering the direct impact of the Law to the CSOs, the Nationwide movement "Yuksalish" has organized the discussion engaging the NGOs and other civil society institutes to consolidate their inputs and forward them to the Ministry of Justice. The main proposals of the discussions have covered:

  1. Developing a clear mechanism for interaction of NGOs and government agencies by determining the types of contracts from small ones, through the introduction of a model of Agreement on the provision of social services for the implementation of small projects and state contracts applying existing practice of providing Agreement for the implementation of a state social contract;
  2. Necessity of consideration of the links of the Law "On Social Partnership" with other legislative acts, for example, the "Law on Public Monitoring", "On Social Services" and compliance with the Law “On Public Control”
  3. Elaborating on compliance of the Law “On social partnership” with determined formats of activities of the Public Chamber and regional Public Councils
  4. Including the function of NGOs on monitoring of the implementation of National Programs and the responsibility of state authorities in the mandatory implementation of social partnership with NGOs in to the law “On Social Partnership”. Allocate 30% of the funds of the Public Fund on the support of NGOs for monitoring of implementation of state programs;
  5. Including the mandatory annual reporting on implementation of the National Programs by the state authorities, including the budget, thereby ensuring the publicity and transparency of the data;
  6. Identifying the ministry responsible for “Social Services for the Population”. Consider the classification and professional orientation of NGOs in fulfilling the state social contract and entering the names and types of social services in the state register. Initiate the inclusion in the law of the development of Standards of Social Services and the cost of social services. Provide the participation of NGOs in the development of Standards for social services. Each state organization to develop a list of social services, standards for each social service and the cost of the social services they need. For each state body, select one full-time specialist who has experience working with NGOs for the implementation of the tasks mentioned and for the implementation of social partnership projects;
  7. Ensuring transparency of information on the provided state funds from the state budget for the implementation of the state social contracts in each state organization;
  8. Determining that only those NGOs that have gone through audit during the last 3 years and have successfully submitted annual reports can receive State Social contracts;
  9. Determining that the registering authority will annually publish a register of existing NGOs (having submitted the annual report) to inform state organizations of competent candidates for implementation of the state social contracts.

The proposals of the CSOs have been passed to the Ministry of Justice for further processes

The second plenary session of the senate of Oliy Majlis has taken place on February 28. It was decided at the meeting of the council (http://senat.uz/ru/lists/view/1087) of the Upper House of the Parliament. At the plenary session, members of the senate have considered a number of acts of legislation and matters of sequential continuation of reforms in socio-economic, judicial and legal spheres, strengthening of the Makhalla and family institutions, protection of child rights. 

In particular, laws of the Republic of Uzbekistan:

  • “On citizenship of the Republic of Uzbekistan”;
  • “On the census of population”;
  • “On  metrology”;
  • “On international commercial arbitration”;
  • “On the ratification of the charter of the Hague conference on international private law (the Hague, October 31, 1951).”

Senators also considered a question of approving the President's Decree on measures to improve the social-cultural atmosphere in the society, further supporting the Makhalla and improvements in the system of actions in the family and women.

The members of the senate have conducted the hearing hear the information of:

  • the Minister of internal affairs on the activities of the internal affairs bodies in the field of combating crime and prevention of crimes in 2019;
  • the Minister of foreign affairs about the activities of the ministry of foreign affairs of Uzbekistan on the performance of the tasks in 2019.

Participants of the plenary session considered the question of directing a Parliamentary request to the Minister's office about the condition of carrying out the doctor and labor experts’ commissions on medical examination of the citizens and defining the disability.

The second session of the first meeting of the Legislative Chamber of the Oliy Majlis has completed.
